LITTLE ROCK – A federal judge in US District Court for the Eastern District of Arkansas ruled against front-line supervisors who sued ConAgra Foods on allegations the company improperly denied overtime pay to front-line supervisors.

In a summary judgment, US District Judge Susan Webber Wright said ConAgra proved the supervisors were employed in an executive capacity, making them exempt from federal and state overtime pay laws. Webber dismissed the lawsuit with prejudice.

"We are pleased with the outcome of the case," a ConAgra spokeswoman said.

A 27-year veteran of ConAgra, Evelyn Garrison filed the lawsuit in November 2012. The federal complaint states that she worked, on average, about 50 to 70 hours per week and did not receive any overtime compensation. However, she did receive non-discretionary bonuses in addition to her salary as part of a company plan.

In its response, ConAgra denied all allegations in the lawsuit and filed a motion to dismiss the lawsuit for unjust enrichment.
