The company and Jason Kuan agreed that Kuan would not use, disclose or disseminate any Cargill confidential and proprietary information and trade secrets, according to court documents filed March 6. Kuan also agreed to return all copies of confidential and proprietary business information and trade secrets he finds during the injunction period, which remains in effect until Dec. 31, 2015.
In addition, Cargill and Kuan each agreed to pay their own costs associated with the litigation, including attorneys' fees, court documents state.
Cargill sued Kuan for breach of contract, alleging he took proprietary information about Cargill before resigning to take a position at JBS USA. Kuan claimed he downloaded the documents because of computer problems.
