NEW YORK — Conagra Brands Inc. faces a proposed class action lawsuit filed by a customer who claims to have sustained injuries after consuming a frozen Banquet chicken strips meal.
The plaintiff Michael O’Sullivan alleged the company used “deceptive and misleading business practices” with respect to its marketing and sales of the frozen entrée product.
The Banquet Chicken Strips Meal was recalled earlier this month due to possible contamination of an extraneous material, namely plastic. Over 245,000 lbs of the product, which was produced on June 20, July 11 and July 17, were recalled.
According to the US Department of Agriculture’s Food Safety and Inspection Service (FSIS), Conagra issued the recall after receiving consumer complaints of plastic found in the product.
New York resident O’Sullivan said he purchased the product and found it “contained dangerous plastic within the food,” leading to unspecified injuries and lost money as a result.
Representing himself and anyone else similarly situated, O’Sullivan is seeking $5 million in damages. The suit, filed with the Southern District Court of New York, requests a trial by jury.
